Supplementary Terms and Conditions

These terms and conditions (together with those stated or reasonably implied anywhere on any other page of this website) apply to reservations confirmed on or after 16 February 2007.

General

You (the hirer), the person named on the booking form I send to you, must be 18 years or more of age when you return the booking form to me. Except by prior agreement you must intend to occupy the cottage for the full duration of your holiday (that is, the period for which you are hiring the cottage).

You are responsible for complying with the terms and conditions explicitly stated or reasonably implied in this website, and any agreement made between us in writing prior to you returning the booking form to me with your first payment.

Your party includes the persons and pets staying with you at the cottage or invited to the cottage by you or any of your party.

You are responsible for the actions of your party.

Your responsibilities as hirer

You are responsible for paying all amounts due for the holiday including any electricity or fuel used (less any allowance agreed).

You and each member of your party must comply with any instructions I give regarding the security and good management of the property or with respect to a neighbour’s property, failing which you are responsible for any consequences.

You must take reasonable care of the cottage and garden and leave it clean and tidy at the end of your holiday. You will be charged the cost of making good any loss or damage (fair wear and tear excepted) including excessive soiling of carpets, upholstery or other occasioned by or permitted by you or any member of your party.

You are responsible for the consequences of any antisocial, un-neighbourly, reckless or criminal conduct by you or any of your party.

Reservations

You confirm your reservation by returning the booking form I sent to you, together with the initial payment I have shown on the form as being due at that time. (For bookings made less than 6 weeks prior to the start of your holiday, the full amount payable for your holiday is required.)

The balance of the total amount payable for your holiday must be received not less than one calendar month prior to the date on which your holiday is to begin, failing which your holiday may at my discretion be treated as cancelled.

Cancellation

If you have not yet sent payment for a holiday, no contract exists: if you wish to cancel all you have to do is let me know, by returning the booking form in the post, or by phone or email. If you have returned the booking form and I have accepted your first payment, then a contract exists between us, and any cancellation must be requested by you in writing and will be subject to the following terms.

On receiving a cancellation request from you four calendar months or more prior to the start of your holiday, I will return to you whatever you have paid to me, less an administration charge of £25 per hired week, and the contract will be cancelled, without further liability on either side.

On receiving a cancellation request from you less than four calendar months prior to the start of your holiday and you have not yet paid the balance due, the contract will be cancelled but you will not be refunded any of the money you have already paid.

On receiving a cancellation request from you less than four calendar months prior to the start of your holiday and you have already paid the balance due, the contract will be cancelled and you will only receive a refund of the good housekeeping and energy deposit.

Miscellaneous

All vehicles and personal property brought to the cottage by you or any member of your party, is entirely at the risk of the person bringing such vehicles or personal property.

Any difficulties or complaints should be brought to my attention as soon as possible, so that the problem can be remedied. I cannot remedy complaints that I was not made aware of during your holiday.

Furnishings and equipment may vary from those shown in photographs, but will be substantively the same in nature and quality.

I reserve the right to enter the property at any reasonable time during your stay in order to check for damage howsoever caused, to assess the need for repairs or replacements, or to carry out urgent repairs or replacements.

Law of Contract.

The contract is subject to the laws of Scotland.

8 Askernish is let as a holiday cottage only.

Where any of these terms or conditions is contrary to law, all other terms and conditions shall remain valid.
